Terms of Service

Please read these terms carefully before using SenddMail software or website.

1. Acceptance of Terms

By downloading, installing, accessing, or using SenddMail software (the “Software”) or our website (senddmail.com), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our Software or website.

2. License & Usage

SenddMail grants you a non-exclusive, non-transferable, revocable license to use the Software for your personal or business email sending activities, subject to these Terms.

  • One-time payment: Purchase gives you lifetime access to the Software version available at time of purchase, plus 1 year of free updates and priority support (if applicable).
  • One-year support/updates: After one year, the Software continues to work, but updates and priority support require renewal at 50% of current price.
  • Unlimited usage: No limits on emails, senders, or campaigns (subject to your SMTP provider’s terms).
  • Installation: You may install the Software on up to 3 devices for the same user/company, unless you purchase an agency/team license.

3. User Responsibilities

You agree to use SenddMail in compliance with all applicable laws and regulations, including but not limited to:

  • CAN-SPAM Act, GDPR, CASL, and other anti-spam laws
  • Obtaining proper consent before emailing recipients
  • Including valid unsubscribe links in your emails
  • Honoring opt-out requests promptly
  • Not using SenddMail to send illegal, harassing, abusive, or deceptive content

  Warning: Misuse of SenddMail for spamming or illegal activities will result in immediate termination of your license without refund.

4. Prohibited Activities

You may NOT:

  • Resell, sublicense, lease, or distribute SenddMail to third parties
  • Modify, reverse engineer, decompile, or create derivative works of the Software
  • Use SenddMail to send emails to purchased, rented, or scraped lists without consent
  • Use SenddMail to send malware, phishing, or fraudulent content
  • Bypass or attempt to bypass any security or license verification mechanisms
  • Use SenddMail in a way that harms our infrastructure or other users

5. Account & Security

SenddMail does not require a cloud account for the software itself; license validation is based on a license key. You are responsible for keeping your license key and local data secure. We are not liable for any loss or damage resulting from unauthorized access to your device or SMTP credentials.

6. Intellectual Property

All intellectual property rights in SenddMail, including but not limited to code, design, logos, and documentation, are owned by TimeSolutionz. Your license does not transfer ownership.

7. Payments & Refunds

All sales are final. SenddMail operates on a no-refund policy because you receive immediate access to the Software. However, we are committed to resolving any technical issues.

  • If you experience a genuine bug or issue that prevents core functionality, we will work to fix it promptly.
  • Refunds will not be issued for change of mind, user error, or failure to comply with your SMTP provider’s terms.
  • In exceptional cases, we may offer a partial credit at our sole discretion.

8. Warranty Disclaimer

SenddMail is provided “as is” and “as available” without any warranties, express or implied. We do not guarantee that the Software will be error-free, uninterrupted, or that it will achieve specific deliverability results (email delivery depends on SMTP providers and recipient servers).

9. Limitation of Liability

To the maximum extent permitted by law, TimeSolutionz and SenddMail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Software, even if advised of the possibility. Our total liability shall not exceed the amount you paid for the Software ($100 or $199, as applicable).

10. Indemnification

You agree to indemnify and hold harmless TimeSolutionz and SenddMail from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or any applicable law, or your misuse of the Software.

11. Termination

We may suspend or terminate your license immediately without notice if you breach these Terms. Upon termination, you must uninstall and delete all copies of the Software. Any provisions that by their nature should survive termination (e.g., liability, indemnification) shall survive.

12. Governing Law

These Terms shall be governed by the laws of Pakistan, without regard to conflict of law provisions. Any disputes shall be resolved exclusively in the courts of Lahore, Pakistan.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email (if you have provided one) or through the Software. Continued use after changes constitutes acceptance of the revised Terms.

14. Entire Agreement

These Terms constitute the entire agreement between you and SenddMail regarding its use, superseding any prior agreements or communications.
